Description of the Service
FoodTruckNearMe acts solely as a discovery platform. The application displays food truck listings published directly by their respective owners and provides links to menus, external navigation apps, and third-party ordering systems.
FoodTruckNearMe does not own, operate, or control any of the listed food trucks, does not guarantee sales for owners, and does not fulfill, prepare, or handle orders or food safety for customers.
Food Truck Owner Responsibilities & Content
As a food truck owner utilizing the Service, you agree to the following terms:
- Content Accuracy & Rights: You represent and warrant that you own or have the legal rights to the business names, logos, photos, and menus you upload. You are entirely responsible for maintaining accurate, truthful information on your profile.
- Location Integrity: You agree to publish only your actual, physical parked location and only locations where you are legally authorized to operate. You must turn your location beacon off or mark it as inactive immediately upon departing a site.
- Prohibited Actions: You may not impersonate any other business, brand, or individual, nor upload content that is illegal, offensive, infringing on intellectual property, or malicious.
- License to Display: By submitting content to FoodTruckNearMe, you grant us a non-exclusive, worldwide, royalty-free license to display, host, and distribute your business information, logos, and media solely for the purpose of providing and promoting the Service. We reserve the right to moderate, hide, or remove any content or profile that violates these Terms.
- Licensing and Regulatory Compliance: You are solely responsible for obtaining and maintaining all licenses, permits, inspections, registrations, approvals, and other governmental authorizations required to operate your food truck in each jurisdiction and location where you conduct business. By creating an account and publishing a location through FoodTruckNearMe, you certify that you are legally authorized to operate at that location.
- No Platform Verification or Approval: FoodTruckNearMe is a discovery and location platform and is not a licensing, inspection, health, zoning, or regulatory authority. Unless expressly stated otherwise, publication of a listing does not mean that FoodTruckNearMe has independently verified, licensed, inspected, approved, or endorsed the food truck or its operations.
- Compliance Reports and Enforcement: FoodTruckNearMe may review reports or other credible information concerning a listed business’s legal authority to operate. We reserve the right, but do not undertake an obligation, to request documentation, temporarily disable location publishing, suspend a listing, or remove an account when we reasonably believe these Terms or applicable legal requirements may have been violated.
Customer Responsibilities
As a visitor or customer utilizing the platform to locate food trucks, you acknowledge that:
- Independent Verification: Truck details can change rapidly. You are responsible for verifying a truck’s current availability, prices, menu items, allergen and ingredient information, and operating hours directly with the food truck or its official ordering service.
- Third-Party Services: External mapping, navigation, and ordering links are supplied by independent third parties. Your interactions with those services are governed entirely by their respective terms and privacy policies.
Billing, Subscriptions, Cancellation, and Refunds
- Recurring Billing: Subscriptions for listing access are billed on a recurring monthly basis through Stripe. [PRODUCTION ACTION REQUIRED: Insert final live subscription amount, currency, and applicable tax terms once finalized.]
- Automatic Renewal & Cancellation: Your subscription will automatically renew each month unless canceled. You may cancel your subscription at your discretion at any time through the Stripe Customer Portal accessible inside your Owner Dashboard.
- Pending Cancellation & Access: Upon initiating a cancellation, your account will reflect an expiration date. You will retain active GPS beacon activation access through the remainder of your current paid billing period.
- Post-Expiration Behavior: Once your paid billing period officially expires, your ability to publish active beacons and update location coordinates will be disabled. Your historical business profile and basic data will be preserved in our system, subject to final production system logic.
- Failed Payments: If a recurring payment fails, Stripe may retry the payment according to its configured retry logic. We reserve the right to temporarily suspend GPS activation access if an account remains past due beyond a 3-day grace period until outstanding balances are resolved.
- Refund Policy: All fees paid are non-refundable. Prorated refunds for partial monthly periods are not provided upon cancellation. If you believe a billing error or duplicate charge has occurred, please contact us through the website within 30 days of the charge. Validated billing errors will be corrected promptly. Never send your full credit card number in any support communication.
Warranties, Liability, and Governing Law
- Disclaimers: The Service is provided on an "as-is" and "as-available" basis. FoodTruckNearMe makes no warranties, express or implied, regarding the uptime of the application, the accuracy of GPS readings, or the operational status of third-party providers such as Supabase, Vercel, Stripe, or OpenFreeMap.
- Limitation of Liability: To the maximum extent permitted by law, FoodTruckNear Me and its operators shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of, or inability to use, the platform.
- Governing Law: These Terms and any disputes arising out of them shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict-of-law principles.
Modifications and Account Management
We reserve the right to modify these Terms at any time. We will notify you of updates by updating the effective date at the top of this page. Continued use of the platform after an update constitutes acceptance of the revised Terms.
We reserve the right to suspend or terminate accounts that breach these Terms.
